1. Objectives – Policy Statement

1.1

All TAFE NSW Institutes and central support units are required to have local guidelines, procedures and workforce development plans that are reviewed annually and updated as required, to ensure that TAFE staff can effectively respond to alcohol, tobacco and other drug-related issues in the learning and work environment.

1.2

This policy aims to promote effective and consistent action within TAFE NSW in responding to illegal, harmful or inappropriate use of alcohol, tobacco and other drugs in the learning and work environment.

2. Audience and Applicability

2.1

This document applies to all staff and students in TAFE NSW. It does not apply to the lawful and responsible use of prescribed or other medication or the appropriate use of alcohol as part of course curriculum, or the use of tobacco in designated areas in compliance with the NSW Smoke-Free Environment Act (NSW) 2000, the associated Smoke-Free Environment Regulation 2007 and the NSW Tobacco Legislation Amendment 2012.

3.Context

3.1

This policy sits within the context of a range of government acts, philosophies, recommendations and departmental policies. Changes to any of these could impact on alcohol, tobacco and other drugs policy in TAFE NSW. Institutes and central support units are required to keep abreast of changes as they occur and make any necessary amendments to their guidelines.

3.2

The National Drug Strategy – Australia’s Integrated Framework 2010-2015 (2011) states that harm minimisation has been the philosophy of Commonwealth and state governments since 1985. Any alcohol and other drugs policy developed by TAFE NSW should be consistent with the current government position.

3.3

The Work, Health and Safety Act 2011 requires:

3.3.1

The person conducting the business or undertaking, the NSW Department of Education and Communities, to ensure, so far as is reasonably practicable, the health and safety of workers and other persons and that they are not put at risk from work carried out as part of the Department’s business or undertakings

3.3.2

Workers to take reasonable care of their own health and safety, and to eliminate or minimise risks to the health and safety of others.

3.4

The Smoke-Free Environment Act (NSW) 2000 introduced a ban on smoking any product or substance that is intended to be smoked in ‘enclosed public places’ or vehicles used by the public, including in relevant places on TAFE NSW premises.

3.5

The Smoke-Free Environment Regulation (2007) informs Institutes and central units of their responsibilities regarding no smoking signage and provides guidelines about determining if a place is ‘enclosed’.

3.6

The NSW Health’s Smoke-free guide: Determining an enclosed public space advises Institutes and central units on what constitutes an ‘enclosed public space’.

3.7

The NSW Tobacco Strategy 2012-2017 outlines the NSW Government’s initiatives to restrict smoking and lower the number of people in NSW who smoke.

3.8

The NSW Tobacco Legislation Amendment 2012extends the outdoor areas where smoking is prohibited from January 7, 2013.

3.9

The NSW Drug Misuse and Trafficking Act (1985) creates a number of offences in relation to the cultivation, supply, administration, possession or manufacture of certain drugs prohibited under the Act.

3.10

The NSW Liquor Act 2007, No 90, regulates and controls the sale and supply of liquor and the use of premises on which liquor is sold or supplied.

4. Responsibilities and Delegations

4.1

All TAFE NSW Institutes and central support units are required to have local guidelines, procedures and workforce development plans, consistent with this policy that are reviewed annually and updated as required, to ensure that TAFE NSW staff can effectively respond to alcohol, tobacco and drug-related issues in the learning and work environment.

4.2

Responsibilities for Directors, General Managers, Senior Managers, general staff, counsellors, student support officers, and health and safety representatives and committees are outlined in the supporting documents of this policy.

5. Monitoring, Evaluation and Reporting Requirements

5.1

This policy is to be reviewed in December 2013 by the TAFE NSW Alcohol and Drug Unit.
